Notice of the Passing of By-Law 92-2024
Take notice that the Council of The Corporation of the City of Oshawa passed By-law 92-2024 on the 24th day of June, 2024 under Section 38 of the Planning Act, R.S.O. 1990, c. P.13, as amended (the “Planning Act”), which repeals By-law 133-2023 effective
June 24, 2024.
On October 30, 2023, Council considered Report ED-23-192 dated October 11, 2023, and passed Interim Control By-law 133-2023 pursuant to Section 38 of the Planning Act to prohibit development along certain portions of the Bloor Street and Simcoe Street South corridors while the City advanced an in-house study to develop an intensification policy framework to guide future development in suitable locations and appropriate types of built form (the “Study”) within the Study area.
On April 29, 2024, Council considered Report ED-24-44 dated April 3, 2024 and, among other matters, endorsed the Study, which satisfied the City’s requirement to undertake an appropriate study for the purpose of passing an interim control by-law under Section 38 of the Planning Act.
On June 24, 2024, Council considered Report ED-24-68 concerning the Bloor-Simcoe Intensification Study and Interim Control By-law 133-2023: Proposed City-initiated Amendments to the Oshawa Official Plan (the “O.O.P.”) and Zoning By-law 60-94, and Draft Master Block Concept Plan and referred the matter to the Municipal Comprehensive Review of the O.O.P., as well as passed By-law 92-2024.

Purpose and Effect of By-law 92-2024
The passage of By-law 92-2024 has resulted in the repeal of By-law 133-2023 effective June 24, 2024.
Pursuant to Section 38(6) of the Planning Act, the provisions of Zoning By-law 60-94 that applied immediately prior to the coming into force of Interim Control By-law 133-2023 again come into force and have effect in respect of all lands, buildings or structures formerly subject to Interim Control By-law 133-2023.
