Notice of Public Meeting - Planning Act - City-initiated Amendments - January 13, 2025
What:
A Planning Act public meeting will be held to consider City-Initiated Amendments to the Oshawa Official Plan and Zoning By-law 60-94 (File: 12-12-4881).
When: January 13, 2025 – 6:30 p.m.
Where:
This public meeting will take place in the Council Chamber, Oshawa City Hall, 50 Centre Street South.
Members of the public wishing to address the Committee through electronic means rather than appear in-person to make a delegation are required to submit their request to speak to this matter no later than 12:00 p.m. on January 10, 2025 by contacting Legislative Services in writing at [email protected].
Members of the public are also invited to submit correspondence concerning this matter. Please address your comments to Legislative Services at [email protected] by 4:30 p.m. on January 7, 2025 in order for your correspondence to be provided on the Agenda. Comments received by Legislative Services after 4:30 p.m. on January 7, 2025 and up to January 10, 2025 at 4:00 p.m. will be provided to Committee members at the January 13, 2025 Public Meeting. Correspondence submitted after 4:00 p.m. on January 10, 2025 should be sent to the City Contact identified below.

Why:
- The proposed amendments to the Oshawa Official Plan and Zoning By-law 60-94 include such matters as:
- Amending Section 9.3 of the Oshawa Official Plan to introduce a new policy that would enable Council to pass an amendment to the Delegation of Authority By-law 29-2009, as amended, in order to delegate the passing of minor zoning by-law amendments and temporary use by-laws to the Commissioner, Economic and Development Services Department, and the Director, Planning Services;
- Amending Section 2.4.5 of the Oshawa Official Plan to add a new Site Specific Policy for the lands comprising the North Kedron Industrial Area specifying that they may only be developed for clusters of business and economic activities including manufacturing, research and development in connection with manufacturing, warehousing, goods movement, associated retail and office, and ancillary facilities;
- Amending Article 3.5.2 of Zoning By-law 60-94 to introduce two new Holding Zones for various sites in the North Kedron Industrial Area to ensure that certain specific requirements have been addressed prior to development on the site proceeding;
- Amending Subsection 3.8 of Zoning By-law 60-94 to introduce a new article to allow the boundary of areas zoned OSE(1) (Environmentally Sensitive Open Space) Zone within the North Kedron Industrial Area to be adjusted following the preparation of appropriate studies to the satisfaction of the City and the Central Lake Ontario Conservation Authority;
- Amending Subsection 5.12 of Zoning By-law 60-94 to permit up to two additional residential units in areas outside of serviced urban areas provided that, where two additional residential units are proposed, at least one of these additional residential units is located within or attached to the principal dwelling, which shall be either single detached dwelling or semi-detached dwelling, and also to update the associated regulations pertaining to accessory apartments (also known as additional dwelling units – A.D.U.s) outside of serviced urban areas accordingly;
- Amending Subsections 27.3, 28.3 and 29.3 of Zoning By-law 60-94 to introduce a new article for each respective subsection relating to the lands being rezoned to allow PI (Prestige Industrial), SI (Select Industrial) and GI (General Industrial) development as shown in hatching under Item 2(c) of this Notice, to permit only industrial-type uses and to implement site specific zoning standards related to such matters as maximum height and location and/or extent of outdoor storage; and, (g) Amending Table 39.3B – Residential Parking Requirements of Zoning By-law 60-94 to reduce the visitor parking rate for rental apartment buildings from 0.33 spaces per unit to 0.30 spaces per unit to match the rate applicable to condominium apartment buildings.
- In addition, various changes for specific properties are proposed as follows:
- Amending Schedule ‘A’ Land Use, of the Oshawa Official Plan to change the underlying land use designation for those lands shown in hatching on the map provided from Prime Agricultural to Industrial, and to delete the “Boundary of Major Urban Area” line feature in certain locations and add a “Boundary of Major Urban Area” line feature in certain locations as generally shown on Map 1 below.
- Amending Schedule ‘A-2’ Corridors and Intensification Areas, of the Oshawa Official Plan to delete the “Boundary of Major Urban Area” line feature in certain locations and add a “Boundary of Major Urban Area” line feature in certain locations as generally shown on Map 2 below.
- Amending Schedule “A” – North Half Map of Zoning By-law 60-94 to rezone the lands shown in hatching on Map 3 below from AG-A (Agricultural) to a site specific PI-A(X) “h-XX” (Prestige Industrial) Zone, a site specific SI-A(X)/GI(X) “h-XX” (Select Industrial/General Industrial) Zone, a site specific SI-A(X)/GI(X) “h-XX” “h-YY” (Select Industrial/General Industrial) Zone and a site specific OSE(1) (Environmentally Sensitive Open Space) Zone.
- Amending Schedule “A” – North Half Map of Zoning By-law 60-94 to rezone the lands shown in hatching on Map 4 below from SI-C “h-45” (Select Industrial) to FD (Future Development) in order to allow existing uses to continue while acknowledging that there currently is no guidance (such as a development proposal) to conclusively determine an appropriate future specific zoning category (or categories) for these lands.

- To Be Notified of the Decision:
- Official Plan: If you wish to be notified of the adoption of the Official Plan Amendment or of the refusal of a request to amend the Official Plan, you must make a written request to the Commissioner, Economic and Development Services Department, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- Zoning: If you wish to be notified of the decision of the City of Oshawa on the proposed zoning by-law amendment, you must make a written request to the Commissioner, Economic and Development Services Department, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- Official Plan: If you wish to be notified of the adoption of the Official Plan Amendment or of the refusal of a request to amend the Official Plan, you must make a written request to the Commissioner, Economic and Development Services Department, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- To Appeal:
- Official Plan: An Official Plan Amendment adopted by Oshawa City Council is forwarded to the Minister of Municipal Affairs and Housing for approval, unless it is determined that the Amendment is exempt from the Minister’s approval during the review process. For an exempt Amendment, the decision to adopt by Oshawa City Council becomes final, subject to any appeals during the statutory appeal period.
If a person or public body would otherwise have an ability to appeal the decision of the City of Oshawa to the Ontario Land Tribunal (Tribunal) but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal, as appropriate, unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
