Notice of Public Meeting - Planning Act - May 5, 2025 - City-initiated Amendments
What:
A Planning Act public meeting will be held to consider City-Initiated Amendments to the Oshawa Official Plan and Zoning By-law 60-94 (File: 12-12-4539).
When: May 5, 2025 – 6:30 p.m.
Where:
This public meeting will take place in the Council Chamber, Oshawa City Hall, 50 Centre Street South.
Members of the public wishing to address the Committee through electronic means rather than appear in-person to make a delegation are required to submit their request to speak to this matter no later than 12:00 p.m. on May 2, 2025 by contacting Legislative Services in writing at [email protected].
Members of the public are also invited to submit correspondence concerning this matter. Please address your comments to Legislative Services at [email protected] by 4:30 p.m. on April 29, 2025 in order for your correspondence to be provided on the Agenda. Comments received by Legislative Services after 4:30 p.m. on April 29, 2025 and up to May 2, 2025 at 4:00 p.m. will be provided to Committee members at the May 5, 2025 Public Meeting. Correspondence submitted after 4:00 p.m. on May 2, 2025 should be sent to the City Contact identified below.

Why:
- The proposed amendments to Zoning By-law 60-94 include such matters as:
- Amending Section 2 to update the definitions of various types of townhouse dwellings/buildings to provide greater clarity regarding each type based on context;
- Amending Section 2 and various other sections and subsections to replace the term “Church” with the term “Place of Worship” to reflect the diversity of religious institutions;
- Amending Section 2 to update the definition of “Home Occupation” to clarify that food catering and food preparation uses are permitted as a home occupation;
- Amending Section 2 and Subsection 5.12 to remove the requirement that 50% of the accessory apartment floor area must be above or below another dwelling unit within the main building, prohibit the severance of an accessory apartment from the main dwelling unit, and amend the definitions of “Semi-detached Building” and “Semi-detached Dwelling” to clarify that a single detached dwelling with an accessory apartment is not a semi-detached building;
- Amending Sections 2, 10, 16, 18 and 19 and Subsection 3.7 to remove reference to a basement being a storey given that the definition of “storey” itself provides the necessary clarity, and to permit dwelling units in basements in the UGC-A (Urban Growth Centre) Zone;
- Amending Subsection 4.10 to permit parking spaces provided on individual driveways in front of private garages serving block townhouse units or back-to-back block townhouse units to be located within 3.0 metres of a street line, provided that the driveway is directly access from a local road;
- Amending Subsection 4.10 to clarify that parking for back-to-back street townhouses is permitted in any side yard, rear yard and on driveways in the front yard;
- Amending Subsection 4.18 to update the weight and length restrictions of commercial vehicles for their parking or storage such that the regulations reflect modern vehicle standards;
- Amending Subsection 4.20 to add language that ensures all Articles in Subsection 4.20 are read wholistically, and to permit storage of recreational vehicles in a Residential Zone on a short-term basis where they would otherwise not be permitted;
- Amending Subsection 5.12 to add language to permit accessory apartments within accessory buildings that may have existed as of February 19, 2025 that do not comply with the current regulations so that they may be permitted to continue to exist in situ provided that they do not exceed a floor area of 70 square metres;
- Amending Section 8 to change “back-to-back townhouse” to “back-to-back street townhouse” to provide clarity on the type of dwelling;
- Amending Section 16 to add a note after certain permitted uses in the UGC (Urban Growth Centre) Zone to draw attention to Subsection 16.4 which affects those particular uses within certain areas as shown in Schedules “G” or “I” of Zoning By-law 60-94;
- Amending Sections 16, 17, 18, 19, 38(A) and 38(B) to permit a “Place of Amusement” in the UGC-A and UGC-B (Urban Growth Centre), PCC (Planned Commercial Centre), PSC-A (Planned Strip Commercial), SW (Special Waterfront) and MU-B and MU-C (Mixed Use) Zones;
- Amending Section 18 and Subsection 5.11 to create a new PSC-C (Planned Strip Commercial) Zone and associated regulations to support mid-rise and high-rise high density mixed-use buildings with lesser residential parking rates on lands located on the north and south sides of King Street West and along the south side of Bond Street West, in recognition and support of policy context of the Provincial Planning Statement, Envision Durham and the Oshawa Official Plan, as well as the planned Durham-Scarborough Bus Rapid Transit service.

In addition, various amendments to the Oshawa Official Plan and/or Zoning By-law 60-94 for specific properties are proposed as follows and as shown on the attached maps:
- Amending Schedule “A” – Maps A2 and B2 of Zoning By-law 60-94 to rezone certain lands on the south sides of Bond Street West and King Street West and the north side of King Street West from various PSC-A (Planned Strip Commercial) Zones to various new PSC-C (Planned Strip Commercial) Zones, including maintaining existing permissions.
- Amending Schedule ”A”, Land Use – North Half, of the Oshawa Official Plan to remove certain lands from the Greenbelt Protected Countryside Area, and amending Schedule “A” – North Half of Zoning By-law 60-94 to rezone the same lands from AG-A (Agricultural) Zone to FD (Future Development).

- To Be Notified of the Decision:
- Official Plan: If you wish to be notified of the adoption of the Official Plan Amendment or of the refusal of a request to amend the Official Plan, you must make a written request to the Commissioner, Economic and Development Services Department, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- Zoning: If you wish to be notified of the decision of the City of Oshawa on the proposed zoning by-law amendment, you must make a written request to the Commissioner, Economic and Development Services Department, 50 Centre Street South, Oshawa, Ontario L1H 3Z7.
- To Appeal:
- Official Plan: The decision to adopt an Official Plan Amendment by Oshawa City Council becomes final, subject to any appeals during the statutory appeal period.
An Official Plan Amendment adopted by Oshawa City Council is forwarded to the Ministry of Municipal Affairs and Housing for approval, unless it is determined that the Amendment is exempt from Minister’s approval during the review process. For an exempt Amendment, the decision to adopt by Oshawa City Council becomes final, subject to any appeals during the statutory appeal period.
If a person or public body would otherwise have an ability to appeal the decision of the City of Oshawa to the Ontario Land Tribunal (Tribunal) but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Oshawa before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal, as appropriate, unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
